These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and alpswitch ("Company," "we," "us," or "our"), a company registered in Italy. By accessing or using any of the Company's services, including but not limited to web hosting, Virtual Private Server (VPS), dedicated server, and domain registration services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must refrain from accessing or using our Services.
By accessing and utilizing our Services, you affirm that you are at least eighteen (18) years of age and possess the legal authority to enter into this agreement. Your use of the Services constitutes acceptance of these Terms and compliance with all applicable laws and regulations of the European Union and the Republic of Italy. The Company reserves the right to modify these Terms at any time without prior notice. Continued use of the Services after any such modifications shall constitute acceptance of the revised Terms.
You agree to provide truthful, accurate, current, and complete information during the registration process and to promptly update such information to maintain its accuracy and completeness. Failure to do so constitutes a breach of these Terms and may result in the immediate termination of your account.
You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password, and for all activities that occur under your account. You agree to notify the Company immediately of any unauthorized use of your account or any other breach of security.
You agree to use the Services only for lawful purposes and in accordance with these Terms and all applicable local, national, and international laws and regulations.
Your use of bandwidth, storage, and other resources must be consistent with the normal usage patterns of the Company's customer base. Excessive consumption of resources that adversely affects the performance of the Company's network or other users' access to the Services is prohibited.
The Company reserves the right to monitor your use of the Services to ensure compliance with this Fair Use Traffic Policy. In cases of excessive use, the Company may, at its sole discretion, apply additional charges, restrict your usage, or suspend or terminate your account without prior notice.
The Company reserves the right to immediately suspend or terminate your account, without prior notice or liability, for any violation of these Terms or any applicable law or regulation. Prohibited activities include, but are not limited to:
Upon suspension or termination of your account, your right to access or use the Services will immediately cease. The Company reserves the right to remove or delete any information or data associated with your account.
To the maximum extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from or relating to your use of the Services or any interruption or cessation of the Services. This includes, but is not limited to, damages for loss of profits, goodwill, data, or other intangible losses.
The Company shall not be liable for any failure to perform its obligations under these Terms due to events beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil disturbance, governmental actions, natural disasters, power outages, and internet or telecommunication failures.
The Company may, at its sole discretion, require you to undergo identity verification procedures ("KYC Process") to comply with applicable laws and regulations. You agree to provide accurate and complete information and documentation as may be requested.
For identity verification purposes, the Company utilizes Stripe Identity services. By proceeding with the KYC Process, you consent to the collection, processing, and storage of your personal data by Stripe in accordance with their Privacy Policy.
Failure to complete the KYC Process or provide accurate information may result in the suspension or termination of your account and access to the Services.
You agree to pay all fees and charges for the Services in accordance with the pricing and payment terms published by the Company. All payments shall be made in the currency specified and are due upon receipt of invoice unless otherwise stated.
All fees are exclusive of applicable taxes, levies, or duties imposed by taxing authorities. You are responsible for the payment of all such taxes, levies, or duties.
In the event of non-payment of any amount due, the Company reserves the right to suspend your access to the Services without prior notice. Access will be reinstated upon receipt of all outstanding amounts.
If payment is not received within a specified period after suspension, the Company may terminate your account and delete all associated data permanently.
Late payments may accrue interest at the maximum rate permitted by law. You agree to reimburse the alpswitch for any costs or expenses incurred in connection with the collection of overdue amounts, including reasonable attorneys' fees and legal costs.
By registering a domain name through the Company, you agree to comply with all terms and conditions of the relevant domain name registry, including but not limited to the policies of the Internet Corporation for Assigned Names and Numbers (ICANN) and the specific registry for the domain's top-level domain (TLD).
You represent and warrant that neither the registration nor the use of the domain name infringes upon the legal rights of any third party, including trademark, copyright, or other intellectual property rights.
You agree to be bound by the Uniform Domain Name Dispute Resolution Policy (UDRP) and any other dispute resolution policy applicable to the TLD in question.
For the registration of .ax domain names, you agree to comply with all terms, conditions, policies, and procedures established by the .ax domain registry, including any modifications thereto.

You acknowledge that the .ax registry has the right to deny, cancel, transfer, or modify any domain registration in accordance with its policies or as required to comply with applicable laws, regulations, or any legal obligations.
Service activation is subject to manual verification and is not instantaneous. Upon receipt of your order and payment, our team will review and verify your information. The activation of Services will typically occur within twenty-four (24) hours but may take longer during weekends, holidays, or due to unforeseen circumstances.
The Company does not offer real-time domain name registrations. All domain registration requests are processed in accordance with the policies of the respective domain registries and are subject to their approval and processing times.
You may terminate your account and use of the Services at any time by providing written notice to the Company. Termination will be effective upon acknowledgment by the Company.
The Company may terminate your access to the Services, with or without cause, upon providing notice to you. Grounds for termination include, but are not limited to, violation of these Terms or any applicable laws or regulations.
Upon termination, all rights granted to you under these Terms will cease immediately. The Company will have no obligation to maintain or forward any content or information in your account.

You agree to indemnify, defend, and hold harmless the Company, its subsidiaries, affiliates, officers, directors, employees, agents, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your violation of these Terms or any applicable law or regulation.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Italy and the European Union, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Bolzano, Italy, for the resolution of any disputes arising out of or relating to these Terms or the Services.
The Company reserves the right, at its sole discretion, to modify or replace these Terms at any time. Any changes will be effective immediately upon posting on the Company's website. It is your responsibility to review these Terms periodically. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall otherwise remain in full force and effect.
These Terms constitute the entire agreement between you and the Company with respect to the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether oral or written.
